ST. MICHAEL CEMETERY , KALIDA , OHIO RULES FOR GOVERNING THE CEMETERY
Purchasers of plots or single graves (also called lots) having made payment in full will receive a Burial Lot Certificate, entitling them to the use of said lots for burial of the dead. Lots will not be regarded as sold until fully paid. Furthermore, the cemetery board may retain all payments made on said lot as reimbursement for trouble and expenses. No burial, monument or improvement will be permitted on any lot or grave against which there is an unpaid charge due the cemetery board.
All burials shall require a vault. Approved vaults shall be of concrete, steel or fiberglass construction.
Lots can be sold only by the Cemetery Board and they, alone, can issue a Burial Lot Certificate. They shall keep a record of lot sales and payment for same.
A holder of a Certificate of Burial Rights will be allowed to sell the certificate only to the Board. The amount refunded will be 75% of the original fee. The Board has the right to accept or refuse the request.
When there is doubt as to whether one is entitled to Catholic burial, conditions listed in the present Code of Canon Law of the Catholic Church will apply.
It shall not be permitted to inter in a lot anyone not a direct descendant of the lot purchaser without the written consent of the owner of the lot, and payment of the sum charged for interment (opening & closing).
Upon the death of the owner of a lot or of a part-owner of a lot, the title to said lot will descend to his or her heirs in equal, undivided shares, in accordance with the law of descent of the State of Ohio , unless said owner or part-owner has deposed of his or her interest by will. But the husband or wife of said owner will retain his or her right to be interred in said lot under all circumstances. If both parents are dead and there remain vacant graves in the family lot, one of the children may obtain from the Board the sole right of burial therein for his or her family, upon payment of any unpaid balance due on the lot. This agreement should be made beforehand by all the children of the deceased. When such an agreement cannot not be arrived, the Board will endeavor to reach an agreement with the family members, and its decision will rule.
A maximum of one regular type burial (not cremation) per grave site. Includes all grave sites (baby, child & adult). And a maximum of two burials (cremation type) per grave site if BOTH are cremated. Price of grave site remains the same.
The poor of the parish, upon their decease, will be interred free of charge where no provisions for burial expenses have been made. Lot site shall be selected by the Board.
The Cemetery Board will not be responsible for damage to graves or markers by acts of vandalism.
Lot owners may place flowers in pots on the graves of their lots, but in no case may they remove sod from the top of graves, e.g., to plant flowers. Strict compliance with this rule will be enforced .
No lot shall be decorated by its owner or anyone else by the planting of trees, shrubs or any type of plant. Strict compliance with this rule will be enforced.
The first Saturday of April will be spring clean-up. Anything left unrespectable will be removed and discarded by the cemetery board.
The landmark, or corner post, indicating the boundaries of lots, will be set by the Board, and same shall not be altered or moved.
No fence coping or enclosure of any kind will be permitted on burial lots. Boxes, shells, stones, toys and similar articles scattered upon graves or the ground around them are not consistent with the proper upkeep of the grounds and will not be permitted .
The Board reserves the right to remove any architectural ornament, flowers, trees and shrubs from lots in cases where they become detrimental to adjacent lots or cause real difficulties for the caretakers. When such removals are requested by the lot owners, the Board alone shall decide whether they are necessary or advisable.
All ordinary work in the care of lots will be the responsibility of the Cemetery Board. Extra work will be seen to by the Board at the expense of the lot owners, when ordered. Payment for same must be made in advance.
All persons employed in the cemetery for the construction of vaults, construction or erection of monuments, etc., shall be subject to the control and direction of the Board, and if they fail or refuse to comply with regulations of the Board, they shall not be permitted again to work in the cemetery without the express permission of the Board.
Foundations for monuments must be in accordance with the size of the monuments and according to the Board rules, i.e., extending 6 inches beyond all sides of the monument. No monument may be placed in the wet season. Only one monument will be allowed on any grave. Maximum depth of monument base will be 18” and maximum length of a base on a single grave will be 48”. Monument footer will be no more than 60”. Frivolous or bizarre designs will not be permitted.
Government markers must be in line with the headstone or attached to the monument.
All monuments must face the center of the cemetery. The center of the old cemetery being the crucifix, and the center of the new cemetery being the memorial.
Snowmobiles, three-wheelers and other motorized recreational vehicles are not allowed in the cemetery. If this rule is violated and damage is done to the grounds or markers, the Board will seek police assistance to apprehend the violators and make sure that the violators repair the damage that was done.
Amendments to these rules shall be made known to all members of the Board prior to a vote on the amendment and shall require a 2/3 majority vote of the members present to pass.
